Builder not cooperating in society formation. Can we register CHS without the builder?

Dear sir, please help and guide in this regard. Almost all flats are sold and people are living there as well. The builder is not giving good services and have deployed very unprofessional people to manage our society. We are facing regular challenges at our society.

We formed a group and met with the builder last Saturday but he is not planning on registering the society or handing over. Some of us suspect they are planning to do more construction.

    Dear Nachiket,

    Yes, it is possible to register a cooperative housing society without the builder. It is always better to have builder onboard but if they are resisting - members can register their cooperative society on their own.

    Our building is constructed before 1995 and most of the flat owners are 2nd purchasers and we want to register our flats but as the society is still under proposed we will like to know the procedure as builder and some of his persons are not cooperating to register them. We have only flat purchase document from the builder without any drawings/plan. We will like to know the documents, fees and procedure for the same.
