Builder refused to run society maintenance and pending issues

Our society formation not yet done. Since 5 years builders project is going on so he was looking maintenance work. He had collect yealy maintenance from society members. Some of members not given regularly so the increaseed expenses difficult to run society properly. Builder collect money and deposit society maintenance account. Now he is saying unble to run society due to unsufficient fund. Can you advise what should action take against builder? He did not keep money as sinking fund also.

Dear Manoj,

Your builder is not liable for sinking fund. So you can go ahead and get a lawyer to form society.
