CHS 38(e)(ix) transfer premium transfer within family

If the flat is transferred by virtue of sale deed but to family member is share transfer premium applicable as foot note and manual clearly indicates exemption. societies lawyer denied the matter only because transfer was done by sale deed.please guide. regards
