Can builder deduct maintenance charges from a prepaid electricity meter?

I'm living in Noida and my flat is a builder floor. The builder asked me for the maintenance charges. Please note that I have not signed any agreement for any kind of maintenance. Since my flat has a prepaid electricity meter which can be only recharged by the builder, he has deducted the maintenance amount from the amount I got my meter recharged. Plus he is not ready to give any receipt for it

Can a builder take maintenance charges when I have not signed any agreement for it?
Can a builder deduct money from prepaid electricity meter?

What is the possible remedies? Should I file an FIR for it? Whom to approach for this?

    Dear Suket,

    Discuss the matter with the concerned person and try to resolve.
    If not resolved, send him a legal notice as he can not manipulate heads of income. After this file a FIR at local police station.

    We have pre-paid electricity meter and electricity provided through DG as builder not deposited fees for grid connection though recieved from flat buyers. we have Common area maintenance charges which builder takes 03 months in advance. Due to non availability or poor services like House keeping, lifts , security etc. etc. few residents have stopped paying maintenance charges. On this builder frequently stopping DG supply . can FIR be lodged on this and under which act? whether builder can refuse to charge pre-paid meter for those who have stopped paying maintenance charges.

    Yes you can File FIR against builder or RWA because it is settled law that If there is no outstanding debit balance for only Electricity related charges in the prepaid meter . In that situation light can not be disconnected. You can approch to CGRF also.

    PREPAID ELECTRICITY METER , THAT IS USING IN THE ALL HI RISES BUILDING.

    ISSUE IS THAT THE METER SHOULD BE USE FOR ONLY ELECTRICITY FIX CHARGES AND ELECTRICITY CONSUMPTION BUT IT HAS BECOME A TOLL OF EXTORTION BECAUSE BUILDING MAINTENANCE CHARGES IS BEING RECOVER THROUGH PREPAID METER BY BUILDER / R.WA., THEY ARE DOING IT ILLEGAL AND DISCONNECTION ELECTRICITY OF CONSUMER IN DEFAULT OF BUILDING MAINTENANCE CHARGES . raj nagar extention, indirapuram, noida , ghaziabad hi rises societies are best example t know it.

    All department like PVVNL, UPPCL are corrupt , CGRF & Lokpal can give decision but have no power to execute his own order. U.P.E.R.C Lucknow know everything but because UPERC is running by single handing person , he is member and chairman also and involve deeply in the curruption.

    HENCE NOTHING REMEDY IS AVAILABLE FOR THE CONSUMER , UP HAS BECOME A HELL FOR THE RESIDENTS OF MULTI STORY APARTMENT OWNERS.
