Deemed Conveyance for Illegal Co-op Housing Society?


13 February 2015 Mr.Sachin Pawar, Mumbai

Building is constructed in 1992. Builder has not taken any permission from the Municipal Authorities like Bandhkam Manjuri, Building Plan Approval, No Commencement Certificate, No Completion Certificate & No OC. Muncipal Tax receipt from Year 1993 conduct the word Illegal Construction. Our Society is registered in Year 2001.

Now, we want to do deemed conveyance. But Land owner is opposing for it due to Illegal construction done by Builder. Development agreement between builder & land owner is on 10 rupee stamp paper with no notary done nither registred the development agreement.

Please advice if we go for deemed conveyance can a result be in our society favour?

    Dear Sachin,

    The government had given amnesty till December 2014. You should have applied in that period. We had advised all our clients / societies to initiate the conveyance deed process last year. Now, its going to be very difficult for you. Now you need most documents hence, a good lawyer is required.
