Defaulter contesting m.c election

A claim has been lodged against an already defaulter. He has converted his resident into a commercial unit. BMC inspected and confirmed it is commercial, his energy bill is for commercial use. BMC raised additional bill for property tax on basis of commercial unit on the society. Society debited the extra amount in his bill. Even otherwise he is a defaulter. He has been allowed to contest managing committee election. Is it right. Can it be challenged.
