There are many factors involved in process of housing society handover from the builder/promoter. You should be very careful while doing the handover. It becomes much easier when the builder/promoter is cooperative as you will need their help even after the handover is done.
Here are some of important factors to address while taking the society handover:
1. Identify the service providers (which the builder is providing now)
2. Society elections, office bearers are identified
3. Society processes and bye-laws are in place
4. Make sure that the builder has completed everything they had committed. If not, you should make them liable in the handover document so that they complete the work even after that handover is done
5. Get all maintenance agreement documents. (e.g. agreement for lift maintenance)
This list is very big. Since you have mentioned all managing committee members are new, we would suggest you hire a cooperative society consultant to make sure smooth cooperative society handover.

We also have similar problem, although the society registration has been done but the builder is not handing over the society.
Recently our building have received attachments orders from BMC towards Property Tax and since we do not have society bank account we are unable to pay property tax
We are worried if BMC takes any action to auction our building

Hi Sir,
We are also facing the first problem. Builder is saying to handover the society to avoid his expenses. I don't think he has registered the society. But he wants to fool us by saying society handover (actually it is society registration I think).

I am a society member of newly developed society in Thane(asangao). builder is planning to give handover all documents and everything. he has taken one meeting for the same and elected chairman, secretory, tresery, and other committee members. Now we dont know what are the documents required from builder while we took society handover. please guide us.
