How to divide the maintenance charge for a society with 1/2/2.5 BHK flats?

Can you please help me understand the society bye laws where its clearly mention that how the maintenance charges to be levied on each flat varying in areas?

    Dear Ajay,

    Here are some guidelines on how to set maintenance charge at cooperative societies. The Committee shall apportion the Share of each member towards the charges of the Society on the following basis:

    1. Sharing of the Society's Charges by the members

    2. Property taxes: As fixed by the Local Authority

    3. Water Charges: On the basis of total number and size of inlets provided in each flat.

    4. Expenses on repairs and maintenance of the building/buildings of the Society: At the rate fixed at the general body from time to time, subject to the minimum of 0.75 percent per annum, of the construction cost of each flat for meeting expenses of normal recurring repairs

    5. Expenses on repairs and maintenance of the lift, including charges for running the lift : Equally by all the members of the building in which lift is provided, irrespective of the fact whether they use the lift or not.

    6. Sinking Fund: As provided under the bye-law.

    7. Service Charges: Equally divided by number of flats.

    8. Parking Charges: At the rate fixed by the general body of the society at its meeting under the bye-law No. 84/85.

    9. Interest on the delayed payment of Charges: At the rate fixed under the bye-law No. 72 to be recovered from the defaulter member.

    10. Repayment of the installment of the loan and interest: The amount of each - installment with interest fixed by the financing agency.

    11. Non-occupancy charges: At the rate fixed under the bye-law No. 43(2)(iii)(c)(10%)

    12. Insurance Charges: The built up areas of each flat, provided that if there is increase in the insurance premium due to storing any specific goods in any flat, used for commercial purposes, the extra burden of insurance premium shall be shared by those who are responsible for such increased premium in proportion of the built up areas to their flats

    13. Lease Rent: The built up area of each flat.

    14. Non-Agricultural tax: The built up area of each flat

    15. Education and Training Fund: Rs. 10 per Flat/unit per month

    16. Election Fund: Equally by the members and as prescribed by the Election Authority in the Rules made thereof and as decided by the General Body meeting of the Society
    Any other charges: As may be decided by the general body of the Society

    17. The Committee shall fix in respect of every flat the society charges on the basis laid as down per above points.

    Also, her are few common myth around setting up maintenance at cooperative housing societies:

    Myth #1: charge maintenance per area of each unit.
    Reality: This is wrong method of calculation. You’ll need special permission from the cooperative registrar if you want to implement this. Also, practically, societies with different flat sizes find it difficult to build consensus on this anyways.

    Myth #2: divide maintenance amount equally per each unit.
    Reality: Some charges are to be divided equally and some per area. For purchased water charges: this can be per point at each unit.

    Myth #3: Row houses, bungalows and flats treated as same.
    Reality: you cannot charge row houses for expenses like lift which they don’t have.

    I stay in a society with row house and flat. I own a row house and is charged lift charges. Is it correct, allowed by bye lays. Can you provide the references.

    Hi, Ours is total 6 flats in the building. Each floor has got 2150 sq ft. 1st and 2nd floor is 2150 sq ft single house, 3rd and 4th floor has 1075 sq ft 2 houses each in the floor, please let me know how to fix the maintenance charges like Security Salary, common area electricity and water charges.

    Sir,

    Q1.We are 5 societies & are planning to form a Apex society. Cud u please highlight the bye laws. Presently the Apex is under Builder & is charging Apex charges Flat wise which is not uniform. Please confirm what is right as per Bye Laws.
    Q2. There were elections declared for our Scty. Acting commitee released PO for installation of CCTV & released advance after the declaration of Elections. It is correct as per Bye Laws.

    I have 2 CAR, Society say Only 1 Car u have to park in Society if u want to park 2 nd car in the society u have to Pay Rs.1000/- per month, its too high, So what is the By e Low rule of deciding Maximum Parking Charges. And please Suggest How to cancel or minimized this Parking Charges.

    Hi, there is a tile in our bathroom which has developed slight crack we are not facing any problem however there is seepage to the house below ours. Could you please guide me as to how to split the cost of repair.

    Dear Karsan,

    Law is very clear. The 97th ammendment clearly states the flat or unit causing leakage has to rectify at their cost.

    Ours is a group of flat owners purchased from builders having 228 flats of various sizes from 1200 Sq Ft to 2000 Sqft - 2 and 3 BHK. The flat owners formed a society registered and the administration is done by common elected members. Majority is of 2 BHK .
    The society expenses are grouped under- Facility maintenance[ Garbage collection, garden, housekeeping, Pest, Repair security, STP etc] , Utility expenses[ BWSSB, Electricity for common area, Water BBMP ] , Plant and Machinery[ AMC charges and depreciation] Office expenses, Staff welfare, Accounts and audit, Misc exp - These expenses can not be charged on Sq Ft Basis as the services are same to all.
    There are court cases on right to equality and right to exploitation. Also it is against fundamental rights , ethics and comes under unfair pricing of services.
    In spite of all these because of majority and and past practices the EC committee is reluctant to change on per flat basis. Is it justify What is the remedy? what is the regulation ?
    Auditors have not also qualified the statement and proper disclosures as per AS1 is not followed in the preparation of accounts. Legal, and opinion of Auditors are sought whether the court decisions on right ti equity and exploitation is not applicable for karnataka , are the practices ethical fare as per accounting policy, non qualification of accounts by auditor - can this be a negligent of duties?

    Ours is a society under Mhada at Charkop Kandivli Mumbai west..I want to know if the Mantainance charges for a 1Bhk and 2Bhk can be same .Our society also charges ,equally for all in monthly bill , ,parking charges,Sinking fund,lease rent & repair fund.
    Only the Municipal taxes vary for 1RoomKitchen,1BHK and 2BHK.
    Kindly let me know if the different area s of flats effect the Mantainance charges

    Our society are going for additional works like terrace shade, CCTV & office. But society don't have fund & going to collect fix fund per flat, where as flat sizes are different ? Kindly suggest

    Society don't have fund, but they are going to do terrace shade, CCTV camera & new set up office for society.
    but they are going to collect fix fund per flat, where as all flats are with different size.
