Issuing of share certificates in cooperative housing society

My housing society is registered in 2011. Conveyance deed is also done. No share certificates have been issued yet. There have been around 40 gift deeds and transfers since then. I Have been given the responsibility of issuing share certificates. I can issue share certificates to members whose flats have not got transferred.

Please suggest what I should do for cases where flat transfer has taken place. Please suggest that can I issue share certificates directly to current members and get all the transfer cases approved in the AGM. Please suggest.

    No sir. You will have to start from date of registration. Employ a professional as 6 registers need to be updated.
    Also, get someone from cooperative department or a cooperative consultant to help you in doing this.

    All the data required for maintaining registers have been collected. My query is whether share certificates can be issued directly to current members with their names written on the front side. OR else the share certificates have to be issued on the name of original members and then transfer it date wise on the back side. Maintaining the society records is not the problem.

    The name on the front will be that of the person whose name was on record at the time and date of registration then the transfer at the back.

    Some people say that you cannot do more than one transfer in a year.Then what happens in the above case, where multiple transfers have to be effected at the time of issuing share certificates

    OUR SCTY SHARE CERTIFICATES {PAPER}IS BEEN SOLID UP. THE PAPER IS IN SUCH A BAD STATE ,IT CANNOT BE LIFTED FROM THE FILE,I FEAR IT MIGHT TEAR OFF. THIS ISSUES IS WITH ALL MOST ALL THE SCTY MEMBERS. WHAT IS THE PROCESS IF SCTY WANTS TO PRINT A NEW SHARE CERTIFICATES AND ISSUE THE SAME TO THE SCTY MEMBERS.

    Hi,

    I have purchased a Flat in Mira Road way back in Feb 2010. The builder had formed the society & handed over the same to the committee members some 3-4 years back. The paper work pertaining to share certificates was completed 3 months back. Still I have not yet received the share certificates. In such scenario what should I do?

    The flat in questions was brought way back in 1960's and we don't have the share certificate details or copy of the same. the building is been redeveloped and the builder insist on the share certificate. The management committee is in dispute with the builder and not providing us the details of our share certificate. What is the other option to obtain share certificate details.

    I have two shops in a soc registered in 2005 but no conveyance deed is done and no share certificate is issued.Are we members of soc.If not can they demand any old dues from us.from 2005 they never had elections and running the soc will illegal commeeti who have not done the oudit till date.there are 10 shops in the soc. due to improper services the shop owners outsourced the services and paid the half the amount of maintenace from thet pocket from almost becoming of 2009.this dragef till March 20012.after this the soc locked the water supply and bathroom facilities also as as a action against shop owner for not paying maintenance.in the Agm took place on Dec 2012 they have passed a resolution of charging rs 50 as fine pm on late payment.which accounts to 200% annual fine over rs200 maitenace charges.Can they charge any fine on old due as the decision of fine was wrong as the bylaw doesn't allow any fine above 21%annual charges.also they tried to extort money by making the calculation as huge as 50000thousan each shop @200pm maitenace and plus fine chages since Sep 2009.I just want to know as this is the senario are we laible to pay anything to soc .no conveance , no share certificate , no proper service ,locking of bathroom and water suply along with all other facilities, harasments,non elected body for more than 10 years ,no audit, mis handeling of soc maitenace cash etc.kindly help as they are demanding old meantanace with 21% of fine now .other shop keeper had paid the money erliar in Nov 2014 were as I paid 20thousand under protest in augest 2015.erliar they were demanding illogical amount from all shop owners but after I raised the objection they have refunded some amout to other 8 shop keeper.now I feel that as we are not member of soc as no share certificate and no cnveance feed they can't demand any maintenace due from us whether old or new.first they should do the conveance and give share certificate then only from that day onwards they can demand the maintenace.

    I had purchased flat recently with all required paperwork & documentation. The required documents are given to society for the transfer of share certificate however original owner did not collect the share certificate and it is with society.

    Now society is asking me to call original owner to collect the same & handover to me rather than updating my details & directly issuing me.

    What could be done in this case , is there any provision in bye laws for this situation?

    I have purchased the flat in Mira Road, Mumbai & have paid stamp duty in the year 1998 & adjudicated in the year 2016 but I did not registered the property at that time . Now I want to register the property and as per the latest circular of the Inspector General of stamp, I am supposed to pay the stamp duty as per present market valuation and prepare the new sale deed for which I am ready but the seller does not want to sign the supplementary sale deed, he is willing only to sign the original sale deed, which is debarred and just harassing us for want of illegal gratification of 2.5 lakhs. Can a Co-op Housing society refuse the share certificate especially when I am paying the maintenance & property tax since 1998 & just because as per the bye laws the sale documents has to be registered before issue of share certificate.

    My society was formed in 1970. The builder/society did not issue any share certificates at that time. Till date some flats have been sold and the society has accepted the purchasers as members on their agreements. Can the society issue fresh share certificates to the present members and what date? Thanks,

    My father have two shop and one agreement having two society maintenance receipts . Can society issue two different share certificates in two different names on basis of one agreement? Society has already issued 10 share in one share certificate.

    IN OUR SOCIETY THERE ARE 30 UNITS OF SHOP AND FLAT OUT OF WHICH 12 UNITS ARE 1 FAMILY WITH 6 MEMBERS NAME CAN I ISSUE SHARE CERTIFICATE TO ALL THE 12 UNITS SEPRETLY OR ISSUE 6 SHARE CERTIFICATE AND WRITE 12 UNITS AT BACK SIDE OF SHARE CERTIFICATE

    I am a secretary of a cooperative housing SERVICE society. All the previous committee had not issued the shares to the society. I want to know that is it compulsory for a CO-OPERATIVE SERVICE HOUSING SOCIETY to issue share certificates to the members or not? If it is compulsory then what is the procedure to issue it

    Hello,
    As per to new amendment bye Law 2014. Individual has to issue 10 shares and company has to issue 20 shares. Society adopted New bye law has to get surrender of all issued share certificate from members and a fresh share certificate with 10 share can be allotted. But society has to adopt new bye Law.
    You can pass a resolution in AGM that the new share will be issued to current occupied flats owner names. Which is approved and acceptable in DDR and as per rules of MSC act.

    I purchased flat in Navi Mumbai, society is registered but no share certificate is issued to any member and even transfer of lease rights(CIDCO) from developer to society is also not done. In this case can society accept transfer fees of Rs. 25000/-. None of the members have knowledge of co. op law.
    Please Advise ASAP.

    I purchased a resale flat and I want to know if a fresh shared certificate will be issued to me or will I get the same old certificate on the previous owners name with a transfer log behind the certificate.

    Process is very very slowly procedure to moveing for society office. As i am going asks, they told Internet isn't connected well & says what l can do?.I gave all proof in two days before,upto now i didn't got information from office. I requested you online process took for it.Please help me.
