Maintenance cost charged for unused flat in Pune

Typical scenario. I have flat in Pune and have paid builder corpous amount for zero maintenance. After 3-4 years now society is formed, builder has not given corpous to society. Society has planned to do civil case against builder to recover corpous amount. To run society they have come up with around 10000.00 per month maintenance including sinking fund, legal fee etc. My flat is vacant since last 4 years and I am asked to pay maintenance charge since incorporation of society. Is this legal and compulsory to pay even I am not living or rented.
