Society Sinking & Repair fund bill to be payble by Builder as well?

Our new society was formed & registered about 1.5 years back but still more than 10 shops & some flats are not sold & remain with the builder. Society is raising maintenance bill to the builder that includes Sinking Fund & Repair Fund, as per MOFA law, But the builder pays only maintenance charge & refuses to pay Sinking & Repair fund. Is this legal? If not, pls let us know the legal clause under which builder has to pay Sinking & Repair Fund contribution, even for unsold units?

    Yes, the society sinking fund and repair fund bill is payable by builder for the unsold flats and shops also.
