To interact with your cooperative registrar best is to visit personally or write via post. Please be aware that cities like Mumbai, Pune has multiple cooperative offices in the city (1 per zone). You should visit the designated cooperative registrar office.

my flat is not getting tranfered from the society because from whome i have purchased the flat was the ex secretary of the same society, and he did some misappropriate use of the funds. Now that he has gone from the society and i have purchased his flat, so the society is not tranfering flat on my name and asking me to pay his use of misappropriate use of funds.

I dont think you should pay for it. Am sure the society had given NOC while purchasing the flat. If yes, then they have no right to do so. You must go complaint to the Registrar if you are being harassed.

If you have applied in writing with the proper method and have an acknowledgements go to the registrar of society for help. But if you have had only verbal conversation, have the written communication done first.

The problem in my case is my seller gave a written application to the society for NOC for selling of his flat. But the society did not gave the NOC nor did they even reverted for the application of NOC to my seller. Then i did some research regarding requirement of NOC from the society for selling or buying of the flat in co-op hsg society. so i went ahead n purchased the flat in which i m currently residing. But now society is not transferring my flat n want me to pay the amt of scam that my seller did.

You are liable for payment from date of admission as member.
As per my knowledge one should always take the NOC before purchasing the flat. Please visit the registrar of your area and check on this issue properly. But in no case should you pay the amount. It is not your fault.

Hi, I bought a flat in Santacruz west, in December 2013, and the seller has completed all the transfer formalities at the time of the deal. I have even paid the transfer fees to the society after i bought this place. After which the society has still not transferred the flat in our name, nor have they taken any meeting in the society. When ever I speak to the Chairman or Secretary of the building, they put blames on each other and do not meet to transfer the flat. Kindly help and suggest what can be done in this regards

You should approach the cooperative registrar (of your area) for deemed membership as the society has not fulfilled it's obligation.
Our flat is purchased in joint names . After completing all the formalities and paying the tranfer fees, The soc. secretary has transferred the share certificate in only first holder's name and is refusing to do so on some whimsical grounds. The matter was brought forth during the AGM . All the members were in the favour of the flat owners but Secretary refused to address the query.

My society have 24 flats and the common open area for car parking , I purchased my flat in year 2007, at that time I was not owing a car, the seller of my flat said its open parking and showed me my parking bay. I brought my car in year of 2008 since then the society is saying we have acute shortage of parking space and I'm parking my car outside the society since 2008. Since it's an open parking is there any law by which I can ask the seceratary to give equal opportunity to me to park the car inside the society? We are a society of 115 flats where last election was held in April 2008. Post that the committee has never conducted an audit, has never shared any accounts and have miserably failed to perform basic duties as office bearers - including documents management and safe keeping.
On several occasions, during meeting held by the committee as well as meetings conducted by members, all have verbally and on paper requested the committee to undertake elections... this is going on for last 3 years and under one or the other pretext the committee has avoiding elections with almost determination.
I understand that we can approach the deputy registrar to act against this committee, however, a general view in the society is that - the medicine is worse than the disease ie . once the registrar appoints a caretaker for the society, it is believed that, it becomes very difficult to get rid of him and his governance is typically like a government servant... you know what I mean.
So pls. advice if our view on the registrar handling the matter is correct or is there any other recourse available to call for new elections.

The whole scty done totally illlegal const. done by all members, incl. sect & chairman too m & they have too much harrasessment only to me by various ways & always send notices since last 20 years .The chairman want to do his drainage go thru from our back side compound instead of his compound the BMC lady inspector Sampat taken bribe from all of them with setting from his coordinator.They all are always threat to us to they killed to me & my family members. In this regared we also noted Polic NC .

Additionally a legal notice can be sent and legal case to be filed in court.
The society has collected the property tax for six months along with the monthly maintenance. Now society has separated the property tax and asked the members to pay this directly to BMC. The society is not adjusting the amount collected (6 months) against the maintenance. Now it is time to pay the same amount directly to BMC. When the last maintenance is not paid, we had given a letter to adjust this amount ; the society has charged penalty for non payment of maintenance. Is this act of the society legitimate ? Who should I approach to put up this case?
I am staying in flat from last one year and society still not transfers flat on our name.
They have mentioned after one year that there is Rs. 25000/- is due by previous flat owner where after few meetings society insisted me to pay Rs. 10000/- and and society will recover balance from previous owner which I got agreed and given first installment of Rs. 5000/-

Ever-since our purchase of the flat in the year 2014, society has started harassing us right from day one when we approached them for transfer of the said flat on our name UNDER SECTION 32 OF THE ACT 1960.
Society has first of all asked for entrance fees of Rs 75000/- in cash besides Rs.25000/- officially for which we have strongly objected being educated alter citizen, but since we were new member we surrendered to the demand of society and paid on money of Rs.75000/- under protest, for which no receipt is issued to us for the said amount which is the practice followed by society for years together. From that day on words society started picking up quarrels with us.
ON 11thOct.2015 society has called AGM 2014-2015 by violating bye-laws 94(a)(b) as there is no provision under law for extension to hold AGBM, in case of default in calling the AGBM as stipulated in the bye- laws 94(a) attracts disqualification and action provided under MSCS ACT 1960 SECTION 75(5).
I have strongly objected the legality of the AGM 2014-2015 taken on 11th day of Oct.2015 and complaint to the sub Registrar K west ward Bandra (East) Mumbai through my Adv. Siraj Ghiwala on 30/10/2015 Exhibit A
On the 04/11/2015 Sub- Registrar has issued show cause notice to the society for which society did not reply till date, shows admission of all my allegation as true and correct.
On 22/01/2016 society has called towing vehicle and police in our absence and removed my vehicle saying un authorized park vehicle subsequently I approached the concerned police station for necessary action .The senior Police Officer on hearing the arguments of both the parties asked the society to maintain status co with the warning that they will not harass me and asked the society to go to the civil court if at all there is any dispute.
Subsequently I brought back my forcibly removed car and again park in the compound which was forcibly removed.
Since the present committee has already violated and the matter is subjudice can the present committee be disqualified under the provision of the act. for having violated bye –laws 94(a)(b)as provide under section 75 (5) of the act 1960.
I was secretary of my CHS and willfully resigned in Sept 2014 when I came to know that the chairman at that time had utilized society's funds for personal benefits. He did not come in any meeting after raising the issue, hence he was terminated in last AGM held in Sept 2014. the new committee appointed since then has till date not held any meeting including AGM. Also, there has been multiple developments in society like setting up new lift, repairing stair case, building of common bathroom/toilet in society compound, in which the expense must have been nothing less than 5-7 lacs, for which no meeting was held, neither any quotation was called for / disclosed to the society members. Since last may we are following up with managing committee for AGM but same is also ignored. Society consists of 32 flats and 2 shops situated at Kandivali west, Charkop.

I am flat owner and want to give my flat on rent to a tenant. Society is charging 10% extra in maintenance bill, which is as per bye laws. But they also want me to pay Rs. 7500 extra as welfare fund. If I don't pay they will not give NOC and create problems for me.
Am I liable to pay Rs. 7500? What should I do about this?

Ours is a cooperative housing society. We have hired some consultant and are undergoing the procedure to get our conveyance done and have our society name on property card for which each flat member had to contribute some amount decided in the society meeting on December 2013.
Society has collected the amount and kept with them as the conveyance is till date under process. They are yet to pay the consultant.
I am a senior citizen running my business. I have not yet paid my share to the society as that amount is earning me interest from my bank. They are charging me interest @ 18% p.a. I have requested them to waive of the interest and I will clear the actual amount as decided by the society. I have been clearing all my maintenance regularly. They are not ready to waive of the interest. They are billing the conveyance amount as incidental expenses for conveyance and saying that it is a part of society maintainence and hence can be charged interest upon as per society bye laws. Now they have sent me a letter calculating simple interest @ 18% p.a. asking me to clear the total amount or else they will take action under section 101.

I reside at kings circle. our society members are fraud and corrupted especially secretary, they have not taken any officially meetings with the tenants nor updated any information to the tenants. now they are forcing to take cheque to the tenants to vacate the houses. they have also not issued share certificate to the most of the tenants. and the secretary has misforged the signatures of the tenants and passed the resolution at the AGM. the record of book which was kept at the entrance of the gate while entering the meeting Bay. its a big Scam going in our area ..Please Help.
