Society registration by the flat owners

W are the resident of Tal. Shahapur, Dist. Thane. Builder had constructed 3 unauthorized flats in the stilt parking area and 3 unauthorized flats on the terrace. The building plan is sanctioned by Collector. As the builder is not interested in forming a Cooperative society, w the flat purchasers have decided to register a Cooperative society by our own. My question is what will be the Builder's right on the above 6 unsold unauthorised flats after our formation of society.
