What can we do against unfair housing society managing committee decision?

Our society managing committee members have charged me a fine for throwing water to remove stench of a dead rat outside my kitchen window.

    Dear SJ DSouza,

    Firstly, write to them that pest control is part of society maintenance. Since they did not do pest control or it was not done properly (whichever applicable), you only cleared the mess that should have been taken care as part of housing society maintenance. If this is not settled then you can approach the cooperative deputy registrar of your area for redressal.

    I have complained about the internal leakage to Society as well as flat owner (where the leakage was occurring ) 5 months ago. Till now society was taking stand that all the internal leakage related cost has to be bear by individual flat owner . After 5 months they have started discussing about making it 50 - 50. As the estimated cost goes around 10 to 15 thousands per head I do not want to bear it. Society has now called AGM to discuss this and most probably it will get passed. (50 - 50 ).

    How I can challenge that?

    I had enough torture due to leakage for past 5 month and on top of that now cost has to be shared. Please note that there is no rule or law which has been passed in society till now.

    Dear Hitesh,

    As per latest directive, the person from where leakage is must pay 100%.

    You can approach the cooperative deputy registrar of your area with your complaint. The deputy registrar can seek explanation from your cooperative society and direct them to act (as required).

    One quick follow up question - Can society amend this law in AGM with 2/3rd majority ? (Instead of 100% make it to 50 - 50 contribution )

    No act superseded the bye-law. However, it can still be done with mutual consent.

    I have been denied to park my car in the building premises. The parking is open for everyone and has been sold to any of the members. But a meeting was held and they said that my car s big so you can't park ur car in the parking slot. They keep harassing me every time I park my car. Whom do I approach with my complaint.

    I reside in Pushyadanth chs sector 21 plot no 65&65A kharghar New Mumbai since 10 years . Now since last 3 years no rules have been followed for selecting Chairman Secretary and treasurer. Last chairman and sectery selected chairman verbly and not taken any consent of the members of the society nor any voting criteria .Now society is beind administered by new chairman but still no meeting has been held in the society since september first week . Also the sweeper of the society comes late and do his work as he wants So many times I complained against the sweeper but society is not ready to taka action against him

    I have recently taken over as Secretary of the society. We removed the sweeper (working from last 8 years) basis non performance. He was given verbal warning many times but he continued to keep the society premises in mess.
    He has approached the Union and union has sent us a notice that he should be employed immediately with a salary hike.
    We don't intend to hire him back. So kindly advise how to tackle this.

    My society has deployed big 7 feet shades in front of all the wings. My flat is on first floor. All waste thrown by above floor people is getting accumulated on the shade along with bird droppings. We have shown this to committee members however it is not helping and they have not removed the shades. Can Society deploy shades like this.. Is this legal basis what is decided on majority in AGM meetings or any other meetings ...I have given written complaint to society. Can I approach BMC if Society does not take any action...

    Dear Sir,
    I am residing in Kandivali west. I am having a flat in Naigaon ( Vasai ) also. Naigaon flat Co-op housing society is registered in the year 2008 - 2009. My brother is staying in the said flat. I am not getting circulars neither for SGM nor for AGM's. This year my brother got a Notice for AGM from the society committee member. They told him that only flat owners can attend AGM. When I saw the said notice, the date on the notice is 24th September 2017 AND AGM is called on 01st October 2017. Now my questions are :
    1. They have given only 7 days notice to attend AGM. Is it legally correct ? if not, then what is to be done ?
    2. Society have so far not issued share Certificates.
    3. I have not attended any meetings since society formation, because I have not received any circular from the society.
    4. I come to know that, Society have already been appointed watchman in the society premises and they have put the point in Agenda that " To Keep a watchman as it is compulsory for Safely". How come society can appoint watchman before AGM or permission from the members ?
    Expecting reply at the earliest.

    I had build box grill much before the society was formed. Now the society has decided to charge 1500 penalty every month if we will not remove the box grill and re-fit the same after 3 notices.
    Kindly advice.

    Our society managing committee members had given a mantains work with out sanction of the members how can i oppose them or ask them for the explanation
