dear sir ,
if the society is made, out of 40 flats 23flats are sold by builder...
so i want to know that rest 17 flats which are not sold by builder
is builder is liable to pay the maintainence charge... amcs of lifts,
if any extra expenses done in development is builder is liabble to pay the
charges...

    Dear Mayank,

    Builder automatically becomes a nominal member and has to pay only, doesn't not have to pay Transfer charge if he sells the unit

    In our building of 422 flats, 260 owners have taken the possession. Once the society is formed, who would be paying the society maintenance charges of those who have not taken the possession - owners or builder?

    Builder might have taken advance Maintenance cost for certain period(Say 2 years) for all 422 purchasers, if so, builder need to take care of the maintenance till the society is formed/till the handing over. Once the society is handed over, the builder should transfer the balance advance maintenance amount collected from the purchaser(balance if any from 260 who had taken possession& balance from 162 who are yet to get possession) to the society. Then going forward society should maintan the society. Please ensure no building activity(excluding the rework/ rectification) is taken by the builder post the society formation. Post society handover, if builder is continuing the construction in the society, then builder should also share the maintenance cost, as builder will be using the common area for construction activity.

    I would like to know which are the specific acts of builder, permit flat purchasers to form CHS, which comes under non cooperation of builder category, as per the MCS Act.
    I also would like to know that, what relief the flat purchasers get in submitting the required necessary papers to form and register this type of CHS.
    What if the builder/developer is having unsold flats in the same building/CHS. Can he become a promoter member in the same CHS which is formed and registered under non cooperation of builder (that's him).
