house transfer fees in gift deed in co operative housing act We are living in joint family, a flat is on my elder brother name and we are going to separate so my elder brother has given flat to me as gift, we had completed the government process for same ,now society has asked for transfer fees for name of transfer I argue to society that there is no financial transaction happened and Municipal corporation and electric department has transferred the name without any charges How can society charge the transfer fee ? where there is not financial transaction happened

    In this case if society is asking transfer premium of Rs. 25000 as well. CAn you please share any guidline from registrar office or court of law.

    There is a question if it is a gift deed between blood relations with no money transactions then why stamp duty is applied when only registration charges can be justified as applicable. So societies who are not profit making org ,for the welfare of all members be allowed half the premium.otherwise justify stamp duty.

Can you please share any guidline from registrar office or court of law.

    at the time of transfer of flat in name of donee (gift receiver) , what forms society requird ? give prforma of the forms...
