Some flat owners refuse to pay pending maintenance charges to builder
Builder has agreed to form society. However he is demanding pending maintenance amount from some flat owners first. These flat owners are refusing payment on the argument that proper maintenance was not done by the builder and they will pay after the society is formed. So we , the prompt payers, are stuck in egg n hen situation. What is the way out. If we adopt noncooperative route to form society will the defaulted payers benifit, or will society and buider loose. We understand that till the society is formed, collecting maintenance charges is the responsibility of the builder. Can he show the loss on this account so that newly formed society can officially collect pending amount. Please guide.
