Water Charges and Water Quota in Societies with unequal flats
Ours is a society with more than 1000 flats in 22 buildings with a mix of 2 & 3 BHK flats. Maintenance charges till recently were levied based on the flat area till recently. We then migrated to the maintenance charges as per Maharashtra State Bye-Laws and water charges were levied as per no. on inlets per flat, which are unequal for 2 & 3 BHK flats.
With this change Society also apportioned the water quota based on the inlets, which earlier was equal for all flats irrespective of the flat size.
As a result with revised maintenance regime, buildings with 2BHK flats now receive less water per flat, compared to 3BHK flats. Is this arrangement legal, particularly when the water quota decided by the local authorities is based on the total number of flat irrespective of the size?
The Bye-Laws only refer to the apportioning of the water charges and is silent on the water share or consumption. Luckily we do not have 1BHK flats. Other wise with this logic they will get only half the quota compared to 3BHK flats.
My question is how to resolve this issue?
