query : Maintenance applicability is from society formation or possession ?
i booked a flat from the builder in 2005,
The apartment owner association registered under
MAHARASHTRA APARTMENT OWNERSHIP ACT, 1970 was formed in 2009
I took my apartment was taken possession in 2013 but apartment association is demanding maintenance from 2009 since when the society was formed.
The occupancy certificate of building is from 2016. before which building should not have been occupied.
I am paying from 2013 but they are compounding the amount from 2009-2013
Also my discussions with them are futile and they are harassing me by putting defaulter notice and not allowing tenants to come.
I stay outside Maharashtra
